Legal Issues in Variance Management Systems

 

  • Patient Related Variance - "[W]here variation from a map is patient driven, the map record provides positive features that can discourage frivolous claims*".

 

  • Provider Related Variance (Good) - "[A] map rewards the provider who is able to give cogent, complete explanations for his or her actions*"

 

  • Provider Related Variance (Bad) - Good documentation is better than no documentation. Can (should) weed out or improve the bad apples.

 

  • System Related Variance - Again, good documentation is better than none.
